By accessing and using the Rutba website (rutba.ca) or visiting our premises, you agree to be bound by the following Terms & Conditions. Please read them carefully. If you do not agree with any part of these terms, please refrain from using our website or services.

1. About Us

Rutba Social Kitchen Bar is a restaurant and bar located in Niagara Falls, Ontario, Canada. References to "Rutba", "we", "us", or "our" in these Terms refer to Rutba Social Kitchen Bar and its operators.

2. Use of Website

By using our website, you confirm that:

• You are at least 18 years of age, or accessing the site under supervision of a parent or guardian.

• You will not use the website for any unlawful or prohibited purpose.

• You will not attempt to gain unauthorised access to any part of the website or its related systems.

• You will not transmit any harmful, offensive, or disruptive content through our website or contact forms.

3. Online Reservations

When making a reservation through our website or third-party booking platforms:

• All reservations are subject to availability and are not confirmed until you receive an acknowledgement from us.

• You agree to provide accurate and complete information including your name, contact number, and email address.

• A credit card may be required to secure reservations for groups of 6 or more, or during peak periods and special events.

• Cancellations must be made at least 24 hours in advance. Late cancellations or no-shows for large group bookings may result in a cancellation fee.

• A 15% gratuity will be automatically added to tables of 6 or more guests.

• Rutba reserves the right to release reserved tables if guests are more than 15 minutes late without prior notice.

4. Events & Private Catering

For private events and catering enquiries:

• All event bookings require a signed agreement and a non-refundable deposit to confirm the date.

• Menu selections and final guest counts must be confirmed no later than 7 days prior to the event.

• Rutba reserves the right to modify or substitute menu items based on seasonal availability.

• Any damages to the venue, equipment, or property caused by guests during a private event will be the financial responsibility of the event organiser.

• Rutba is not liable for any injuries, losses, or damages sustained by guests during events unless caused by our direct negligence.

5. Menu & Pricing

• All menu items and prices displayed on our website are subject to change without prior notice.

• All dishes are made to order. Some items may take more than 30 minutes to prepare.

• Menu items may contain allergens including gluten, nuts, dairy, shellfish, and mustard. Please inform your server of any dietary requirements or allergies before ordering.

• Rutba cannot guarantee a completely allergen-free environment due to the nature of our kitchen operations.

• All prices are in Canadian Dollars (CAD) and exclusive of applicable taxes unless otherwise stated.

6. Alcohol Service

• Rutba holds a valid liquor licence under the Liquor Licence and Control Act (Ontario).

• We reserve the right to refuse alcohol service to any guest who appears to be intoxicated, is under the legal drinking age (19+), or cannot provide valid government-issued photo ID upon request.

• It is illegal for persons under the age of 19 to purchase or consume alcohol on our premises.

• Rutba promotes responsible alcohol consumption and will not serve guests who are visibly intoxicated.

7. Gift Cards

• Rutba gift cards are redeemable for food and beverages at our Niagara Falls location only.

• Gift cards have no expiry date and are non-refundable and non-transferable for cash.

• Lost or stolen gift cards cannot be replaced.

• Gift cards cannot be used to purchase other gift cards.

• Any remaining balance will not be returned as cash but can be applied to future visits.

8. Intellectual Property

All content on this website, including but not limited to text, photography, graphics, logos, branding, menu designs, and the Rutba name and logo, is the exclusive intellectual property of Rutba Social Kitchen Bar. Unauthorised reproduction, distribution, or use of any content without written permission is strictly prohibited.

9. Photography & Social Media

• Guests are welcome to take personal photographs and videos within the restaurant for personal, non-commercial use.

• By tagging Rutba or sharing content related to your visit on social media, you grant us permission to reshare your content for promotional purposes with credit.

• Professional photography or videography on our premises requires prior written consent from management.

• Rutba reserves the right to photograph and record within the restaurant for marketing and promotional purposes.

10. Privacy & Data

Your privacy matters to us. Any personal information collected through our website (reservation forms, contact forms, newsletter sign-ups) is used solely to provide and improve our services. We do not sell, rent, or share your personal data with third parties except as required by law or to process your booking. Please refer to our Privacy Policy for full details.

11. Third-Party Links & Platforms

Our website may contain links to third-party platforms including reservation systems, social media, and delivery partners. Rutba is not responsible for the content, accuracy, or practices of any third-party websites. Accessing these links is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

• Rutba shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services.

• Rutba makes no warranties, express or implied, regarding the accuracy, completeness, or availability of the website content.

• We are not responsible for any loss or damage arising from circumstances beyond our reasonable control, including but not limited to system outages, technical errors, or force majeure events.

13. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
